Terms of Use
Effective date: September 5, 2026. These terms govern your use of www.trainbeyond.com (the "Site"), operated by TrainBeyond LLC, a Texas limited liability company ("TrainBeyond", "we", "us"). By using the Site you agree to them. If you do not agree, do not use the Site.
The Site and the platform are different things
The Site is our public website: product information, the gallery of captures, the blog and a contact page. The TrainBeyond training platform, the modules our customers run on headsets, desktops and phones, and the account area at app.trainbeyond.com are provided under a separate subscription agreement or order form between TrainBeyond and each customer. Nothing on the Site creates a subscription, a licence to the platform, or a commitment to deliver training. If these terms and a signed agreement conflict, the signed agreement wins for the platform.
Using the Site
You may browse the Site and share links to it for your own information and for evaluating our services. You may not:
- copy, download, re-host or redistribute the videos, images, captures or text on the Site except by sharing a link or as allowed below;
- scrape the Site or run automated tools against it beyond what a normal search-engine crawler does;
- attempt to gain access to any system, account or data you are not authorised to use;
- use the Site to send unsolicited messages, or in any way that breaks the law or infringes anyone's rights.
Journalists, analysts and customers may reproduce short excerpts and single frames from the Site for reporting or internal evaluation, with attribution to TrainBeyond. Any other reuse needs our written permission: support@trainbeyond.com.
Intellectual property
The Site, its design, text, software, videos, images and captures of training scenarios are owned by TrainBeyond LLC or its licensors and are protected by copyright and other laws. TrainBeyond and the TrainBeyond logo are trademarks of TrainBeyond LLC. "Level up your workforce" is a registered trademark of TrainBeyond LLC. Other names on the Site, such as Meta Quest, OSHA, API, ISO and the names of Mexican standards, belong to their respective owners and are used only to describe compatibility or alignment; they do not imply endorsement.
Information is not advice
The blog and the module pages describe safety standards such as OSHA regulations, API practices and the Mexican NOM-STPS standards, and explain how our training relates to them. This is general information, not legal, regulatory or engineering advice, and it may not reflect the latest version of a standard. Compliance with any standard at a workplace remains the responsibility of the employer. Neither OSHA, the STPS nor any other regulator approves, certifies or endorses TrainBeyond's training. Where we state that we issue a training certificate, such as the Mexican DC-3, that certificate documents that training was delivered; it does not certify compliance with a standard.
The captures on the Site show simulated scenarios. They are not instructions for performing any real procedure, and you must never rely on them in place of your employer's procedures, permits and supervision.
Prices and offers
The Site does not publish prices. Nothing on it is an offer, and any figure quoted to you in conversation or correspondence is indicative until it is confirmed in writing. Pricing, taxes, currency and payment terms are fixed only in a written quote or order form.
Contact form and demo requests
Sending us a message does not oblige us to respond, provide a demo or enter into a contract. A demo, when we agree to one, is provided as a demonstration only, and any scene we build from a procedure you send us remains our property unless a signed agreement says otherwise.
Third-party links
The Site links to other websites, including the sites of regulators and standards bodies. We do not control them and are not responsible for their content or their privacy practices.
Privacy
How we handle personal data on the Site is described in our Privacy Policy, which forms part of these terms.
Disclaimer of warranties
The Site is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about the Site, express or implied, including that it will be accurate, complete, uninterrupted or free of errors or harmful components. Content may be out of date, and we may change or remove any part of the Site at any time.
Limitation of liability
To the fullest extent the law allows, TrainBeyond and its officers, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data or business, arising from your use of, or inability to use, the Site or anything on it. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, and they apply only to the extent permitted where you live. Nothing in these terms limits liability that cannot be limited by law, and nothing limits the liability set out in a signed agreement for the platform.
Indemnity
If you use the Site in breach of these terms or the law and a third party brings a claim against us as a result, you agree to compensate us for the losses and reasonable costs that claim causes.
Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules, and the state and federal courts in Harris County, Texas have exclusive jurisdiction over any dispute relating to the Site. This applies wherever you use the Site from, including Mexico. Nothing in this section removes rights you have as a consumer under mandatory local law, including Mexican consumer law where it applies.
General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. These terms and the Privacy Policy are the entire agreement between you and TrainBeyond LLC about the Site. We may update these terms; the effective date at the top shows the current version, and your continued use of the Site after a change means you accept it.
